After a biased and unfair decision made by Canada Immigration Centre in Niagara Falls, the Altun family joined the hundreds of thousand of the undocumented workers whose attempt to remain in Canada have met with a stone wall.. The last ditch for a stay by the family’s lawyers on 15 July 2008, just two days prior to the deportation day, was denied by a judge who used to be a government lawyer. The judge considering the case looked blank throughout the proceedings. Moreover, when the government lawyer was making her submissions, he did not take notes but rather stared at the family’s lawyer Barbara Jackman. The Altun family is now seeking for sanctuary in a church.
Back ground information
The claimant, Ali Gul Altun, his wife, Fatma, and his son, Berkan, are Kurdish Alevis. The claimant comes from Tavla village of Sarız in the provice of Kayseri.
In his personal information form, the claimant related many incidents of persecution.
On 21 June 2000, the claimant and his family left Turkey with the help of the agent. They flew to Miami. In order to avoid arrest in USA, the claimant made a refugee claim there. After being interviewed by the American officials, they made their way to Canada and claimed refugee status at the Canadian border.
A negative decision was made on Mr. Altun’s refugee claim at the first level on 25 June 2001. On legal advice, the family did not appeal the decision.
The facts
Mr. Altun had been working for the last six years as a cement worker. Does Canada need cement workers? Yes. Since Mr. Altun is a skilled worker, why we are deporting him?
Mr. Altun purchased a house at 551 Roding Road. Doesn’t that show successfully establishment, and in a very short period, given his grade five education?
The Altun family has a Canadian born child. Do his family ties in Canada count for nothing? His Canadian born child now is hiding with his family and suffers the same fate as the rest of his family members. Isn’t this a violation of human rights?
Mr. Altun has a sister who is a Canadian citizen and several cousins as well. Dozens of families came from his village. Doesn’t that prove that he has ties in Canada?
Mr. Altun is a member of Canada Alevi Culture Centre and did some voluntary work for our newspaper Yeni Hayat. Is this not sufficient to prove that he contributed to his community?
Mr. Altun had a work-related accident. He was required to do modified work. He was scheduled to see a doctor assigned by Workers Security Insurance Board (WSIB). However, he was unable to make this appointment because he was ordered to leave Canada. Judges of the Federal Court have granted stays on other occasions on similar grounds. Why is the law interpreted differently? Where are the rights of an injured worker?
Mr. Altun and his family had previously been subjected to a negative PRRA decision which was overturned by the Federal Court. However the officer who reconsidered the PRAA ignored all the evidence the family had provided and did not give the family an opportunity to make humanitarian and compassionate submissions. The same officer called Mr. Altun’s house just one day prior to her decision as part of a lip service to justice. Without an interpreter she asked questions about his employment, house. She never asked any questions about his children. Is this called fairness?
This call for those who cannot express themselves
Since Mr. Altun had done some voluntary work for our newspaper Yeni Hayat, we will be his voice while he remains in hiding. Mr. Altun was elected to our editorial board as an honorary member.
The immigration system has created modern robots, who do not care about human suffering. When we talk about fairness, equality and refugee rights these words are destroyed by those robots.
After having studied the case and consulted with many people, we believe this is a case of a bona fide refugee for whom the wrong decision has been reached. We also believe that, subsequent to the decision, factual evidence has come forward which backs Mr. Altun and his family’s fears. We have no doubt that Mr. Altun has a well-founded fear of persecution. Mr. Altun has already suffered detention, harassment, and torture.
We call on politicians, trade unions, communities and NGOs to lobby and put pressure on the government to resolve the plight of the hundred thousand of undocumented workers whose plight is similar to Mr. Altun’s and we also humbly implore the minister to review Mr. Altun file.

Mr Altun is a valuable asset to construction industry
There is a shortage of skilled construction workers in Ontario. The shortage is being filled at the present time by undocumented construction workers or by refugee claimants who are under threat of deportation.
At various times, there have been efforts to try to get the government to consider taking some steps to regularize the situation with respect to the undocumented workers. Just few weeks before federal election, silenced undocumented peoples voice should be raised and the immigration system should allow for the undocumented workers to regularize themselves case by case or up to considering an individual security background checked amnesty.
The provincial government should create a provincial nominee program that allowed for the issuance of work permits to specified occupations, in this case, Mr Altun’s skill cement finishers, bricklayers, carpenters,, crane operators… This could alleviate the program as well. Persons could be issued approvals as provincial nominees and be processed a work permit on an expedited basis. To be eligible for that program individual must have valuable skill and Mr Altun’s job can be certified that no Canadian can fill the position because degree of skill needed. Again, given the acute labour shortage in the construction field, Mr. Altun must obtain permanent residence statue to stay with his Canadian born son.
Case Management Branch in Ottawa and Provincial Immigration Officials should look into skilled workers deportation more closely.
I am calling upon Honourable Minister Diane Finley to review Mr. Aligul Altun’s file. Mr Altun who has a Canadian born child, Canadian Citizen sister, many Canadian citizen cousins and a job that can not easily be filled by someone else because of Mr. Altun’ unmatchable skill.
I hope Canadian officials with human sense hears Mr Altun Family’s cry and put an human face to immigration system.
